Sale by auction
The sale will take place by bidding to the highest bidder. The latter is obliged to pay the auction price of the lot in cash (cash for any amount less than 3,000 euros, bank check or debit card/credit card), increased by 23% for costs and VAT. A surcharge of 1.5% is charged for each payment by credit card.
Resale right
In addition, a resale right of 4% will be applied to lots whose artist’s name is followed by the asterisk (*), with respect to works by artists who lived or died less than 70 years ago, for all sales equal to or greater than € 2,000.
As is
Lots are sold as is. The description of the objects offered for sale included in the catalogue should be considered as purely indicative, with the public being able to see the nature and condition of the item offered at the auction at the prior exhibition.
Dispute resolution
In the event of a dispute or an error in the attribution, the bailiff or the acting notary will resolve, in absolute sovereignty and without appeal, any dispute that may arise with regard to the auctions during the sale.
Seller’s rights
The organizer of the sale reserves the right to refuse any bid, to make any decision, meeting, divide or withdraw lots without having to justify his decision. (Please note: all lots are sold individually, except in the case where it is clearly stated “for the lot”)
Passing of risk
Profits and risks pass to the buyer at the auction. However, he only becomes the owner after full payment of the price and accessories. Any complaint must, under penalty of inadmissibility, reach us by registered letter within 10 days of the auction.
Buyer’s obligations
Buyers are required to pay and take delivery of the lots auctioned to them after the auction session (or possibly by appointment within 7 days of the auction. This appointment must be made after the auction or the following day). After this period, the organizer of the sale reserves the right to transfer the uncollected lots to storage, at the expense, and risk of the buyer.
Unpaid lots
In case of non-payment, Auctions & Collections BV reserves the right to offer the unpaid lots for re-sale without prior notice. They may be re-auctioned by a crazy auction as soon as the organizer of the sale deems it appropriate. In this case, the buyer will be obliged to pay the eventual price difference as well as all related costs and expenses necessary to be able to re-attribute the lot. He cannot claim the own risk if it exists.
Buyer’s liability
The buyer is deemed to be acting on his own account and is personally responsible for the payment of the lots awarded to him of any quality whatsoever.
Invoices
In accordance with the VAT legislation, invoices must be requested by buyers no later than immediately after the sale.
Jurisdiction
In the event of a dispute, only the courts of Ghent are competent.
